n. The use of reasonable force to protect oneself or members of the family from bodily harm from the attack of an aggressor, if the defender has reason to believe he/she/they is/are in danger. Self-defense is a common defense by a person accused of assault, battery or homicide. The force used in self-defense may be sufficient for protection from apparent harm (not just an empty verbal threat) or to halt any danger from attack, but cannot be an excuse to continue the attack or use excessive force.
Examples: an unarmed man punches allen alibi, who hits the attacker with a baseball bat.
This principle is fundamental in that it establishes that the person claiming self-defense, must indeed have actually been defending him or herself rather than initiating the violence. Generally, if the person is seen to have been the aggressor or otherwise "thrown the first punch" this would preclude him or her from a successful self-defense claim. However, there are certain instances in which the person can be said to regain their innocence.
As an additional element, self-defense and defense of others also require that the force used is proportional to the threat faced. This is very important in the context of deadly force. A criminal defendant may not use deadly force to respond to a threat that was not itself deadly. Thus, for example, if a defendant is faced with the threat of being punched in the face during an argument, he cannot respond by stabbing the other individual. This would not constitute self-defense. However, if the defendant believes he is about to be shot and shoots back, this may be considered proportional force.
Under the old laws, there was no express "defensive purpose" requirement. Rather, a defensive purpose was implied by combination of the physical and mental elements of the applicable defence. Under the new law, only force which is actually used for the purpose of self-defence (or defence of another) is permitted. Reasons for the change: an express purpose requirement is intended to ensure that the defence succeeds only where the actions were taken for a genuinely defensive purpose. It ensures that where triggering circumstances are present (i. E. A reasonably based belief in a threat or application of force) but the primary purpose of resistance is something other than defence of a person's bodily integrity, the defence will not succeed.

It refers to the use of force to repel an attack or imminent threat of attack directed against oneself or others or a legally protected interest. Self-defense in international law refers to the inherent right of a state to use of force in response to an armed attack. Self-defense is one of the exceptions to the prohibition against use of force under article 2(4) of the un charter and customary international law. However, whether the armed attack that gives rise to self-defence should originate from another state (as opposed to an armed group) and whether the attack should actually materialize to lawfully invoke self-defense are ongoing conundrums for scholars.
